Antoniego J\u00f3zefczaka 29\/40, 41\u2011902 Bytom, nip 626 303 74 81, REGON 385370626, KRS 0000824003, entered into the register of entrepreneurs kept by the District Court Katowice-Wsch\u00f3d in\u00a0Katowice, 8th Commercial Division of the National Court Register (hereinafter referred to as the Administrator).<\/li>\n\n\n\n<li>In\u00a0matters related to the\u00a0processing of personal data, you can contact the Controller at the correspondence address indicated above or the Data Protection Officer at the\u00a0following e-mail address: iod@misot.pl.<\/li>\n\n\n\n<li>The Controller processes data in accordance with the GDPR, the Personal Data Protection Act, the provisions on electronic communication, the Act on the National Cybersecurity System (KSC) and other relevant provisions of law.<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-zasady-przetwarzania-danych\" class=\"wp-block-heading\"><strong>Principles of Data Processing<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list has-medium-font-size\">\n<li>The Administrator processes personal data in accordance with the principles of: legality, reliability, transparency, minimization, adequacy, correctness, limitation of storage and confidentiality and\u00a0integrity of data.<\/li>\n\n\n\n<li>The data is processed to the\u00a0extent necessary to\u00a0achieve the specified purposes and\u00a0only for as long as it is necessary to achieve them or as required by law.<\/li>\n\n\n\n<li>In particular, the Controller may process:\n<ul class=\"wp-block-list\">\n<li>identification and\u00a0contact details (name, surname, company name, e-mail, telephone, correspondence address),<\/li>\n\n\n\n<li>data on business relations and\u00a0contracts (invoice data, billing history, content of correspondence),<\/li>\n\n\n\n<li>data related to the\u00a0use of\u00a0the Website (IP address, data on\u00a0activity on the\u00a0Website, cookie identifiers, data on the device and\u00a0browser),<\/li>\n\n\n\n<li>data of third parties provided by the user (e.g. contact persons, event participants) \u2013 the user declares that he is entitled to provide them,<\/li>\n\n\n\n<li>data related to network traffic and the provision of telecommunications services to the\u00a0extent specified in the\u00a0regulations on electronic communications, the GDPR and\u00a0Directive 2002\/58\/EC<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-cele-i-podstawy-prawne-przetwarzania\" class=\"wp-block-heading\"><strong>Purposes and legal grounds for processing<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Controller may process your data for the\u00a0following purposes:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">use of\u00a0the Website and ICT security \u2013 provision of content and\u00a0functionality of the Website, including forms, information materials and multimedia content \u2013 necessity to\u00a0perform the contract for the provision of services by electronic means (legal basis: Article 6 (1) (b) of the GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">analysis of network traffic, ensuring the security of the Website, prevention of abuse and security incidents \u2013 the legitimate interest of the Administrator (legal basis: Article 6 (1) (f) of the GDPR) and obligations arising from the Act of 5 July 2018 on the national cybersecurity system (hereinafter referred to as: KSC) and cybersecurity regulations;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">contact and\u00a0handling of inquiries \u2013 answering\u00a0questions sent via the contact form or e-mail, conducting correspondence and\u00a0settling the case \u2013 the legitimate interest of the Administrator (legal basis: Article 6 (1) (f) of the GDPR), and\u00a0in the scope of data necessary to\u00a0provide the service \u2013 the necessity to\u00a0perform the contract (legal basis: Article 6 (1) (b) of the GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">newsletter and marketing communication \u2013 sending newsletters, industry information, invitations to\u00a0events and other marketing content (including PING, ISPortal) \u2013 on the basis of consent (legal basis: Article 6 (1) (a) of the GDPR) and provisions on the provision of electronic services;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">events, conferences, trainings and\u00a0conventions \u2013 registration and\u00a0participation in\u00a0events (e.g. Mi\u015aOT Convention, workshops, conferences), handling of applications, organizational communication, settlements \u2013 necessity to\u00a0perform the contract (legal basis: Article 6 (1) (b) of the GDPR) and the legitimate interest of the Administrator (legal basis: Article 6 (1) (f) of the GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">provision of services and\u00a0handling of B2B\/B2C relations \u2013 conclusion and\u00a0performance of contracts regarding the offered solutions (including EPIX, Data Center, TeleCentrum, NET47\/CRM, tsec\/cybersecurity, Sencito\/IoT, voice services, tenders and\u00a0other projects of the Mi\u015aOT Group) \u2013 necessity to\u00a0perform the contract (legal basis: Article 6 (1) (b) of the GDPR) and to\u00a0fulfill legal obligations, including tax and\u00a0accounting obligations (legal basis: Article 6 (1) (c) of the GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">ongoing communication with\u00a0customers, partners, suppliers and persons indicated as contact persons \u2013 legitimate interest of the Controller (legal basis: Article 6 (1) (f) of the GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">online marketing and\u00a0analytical activities \u2013 conducting marketing, remarketing and\u00a0statistical activities based on data collected using cookies (marketing and\u00a0analytical), including the use of external tools (e.g. Google Analytics, advertising systems, social media) \u2013 on the basis of consent (legal basis: Article 6 (1) (a) of the GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">analysis of how to use the Website, measurement of the effectiveness of the campaign, optimization of content and\u00a0functionality \u2013 the Administrator's legitimate interest (legal basis: Article 6 (1) (f) of the GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">fulfillment of legal obligations \u2013 accounting, tax documentation, archiving of documents, fulfillment of obligations arising from the provisions of electronic communication and KSC, as well\u00a0as responses to\u00a0requests of authorized bodies \u2013 fulfillment of a legal obligation (legal basis: Article 6 (1) (c) of the GDPR).<\/li>\n\n\n\n<li class=\"has-medium-font-size\">pursuing claims and\u00a0defending against claims - determining, pursuing or defending against claims arising from the conducted activity, concluded contracts and\u00a0conducted proceedings \u2013 legitimate interest of the Controller (legal basis: Article 6 (1) (f) of the GDPR).<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-obowiazek-lub-dobrowolnosc-podania-danych\" class=\"wp-block-heading\"><strong>The obligation or voluntary submission of personal data:<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">Providing data as part of contact, registration, application or contractual forms is voluntary, but necessary to\u00a0provide a specific service or to settle the matter. Failure to provide them may make it impossible, for example, to respond to an inquiry, register for\u00a0an event, conclude a contract or execute an order.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Providing data for analytical and\u00a0marketing purposes (e.g. as part of cookies) is voluntary and\u00a0subject to consent. Lack of consent or its withdrawal does not affect the\u00a0possibility of using the\u00a0Website, although it may limit the availability of some functions or the personalization of content.<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-okres-przechowywania-danych\" class=\"wp-block-heading\"><strong>Data retention period<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">The data will be stored for the period necessary to\u00a0achieve the given purpose of processing, and\u00a0then for the period required by law or until the expiry of the limitation period for claims.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Data processed on the\u00a0basis of consent (e.g. newsletter, marketing\/analytical cookies) are stored until the consent is withdrawn.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Data related to the performance of contracts and settlements are stored for the period required by tax and\u00a0accounting regulations (usually 5 years from the end of the tax year in\u00a0which the tax obligation arose) and until the expiry of the limitation period for civil law claims.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Data used for analytical and\u00a0marketing purposes based on cookies are stored for the lifetime of individual cookies or until the browser settings are changed or consent is withdrawn in the cookie management mechanism.<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-kategorie-danych-telekomunikacyjnych-i-szczegolne-cele\" class=\"wp-block-heading\"><strong>Telecommunications data categories and\u00a0specific purposes<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">As a telecommunications entrepreneur, the Administrator also processes the data of subscribers and end users in the scope and\u00a0on the terms specified in the regulations on electronic communication and other special provisions. This may include in\u00a0particular:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">subscriber's details (name, surname\/name, address, contact details, contract and\u00a0billing details),<\/li>\n\n\n\n<li class=\"has-medium-font-size\">network and\u00a0device user identification data (service numbers, device identifiers, SIM cards, logins),<\/li>\n\n\n\n<li class=\"has-medium-font-size\">traffic data (initial and\u00a0target numbers, dates and\u00a0times, duration, amount of data transmitted, IP addresses, connection attempts),<\/li>\n\n\n\n<li class=\"has-medium-font-size\">location data (base stations, access points, installation address, place of service provision),<\/li>\n\n\n\n<li class=\"has-medium-font-size\">data necessary to\u00a0handle complaints and network security (notifications, technical logs, information about\u00a0incidents).<\/li>\n<\/ol>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">These data are processed, among others, in\u00a0order to perform the contract, settlements, network security, fulfillment of legal obligations (including data retention) and sharing data with authorized bodies to the\u00a0extent provided for by law<\/p>\n\n\n\n<h2 id=\"h-udostepnianie-danych-organom-i-retencja-telekomunikacyjna\" class=\"wp-block-heading\"><strong>Data sharing with authorities and telecommunications retention<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">The Administrator is obliged to share certain data, including connection, location and\u00a0subscriber data, only with authorized entities (e.g. courts, prosecutor's office, police, other services, regulatory authorities), in\u00a0cases and to the extent provided for by law.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">The disclosure takes place on the\u00a0basis of the relevant provisions and the request or application of the authority and to the extent necessary to\u00a0implement these provisions.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">The administrator keeps records of data sharing with authorized bodies, if required by law.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Telecommunications data, including traffic and\u00a0location data, are retained for the period required by applicable retention laws and\u00a0then deleted or anonymized; the exact periods may vary depending on the type of data, services and\u00a0current regulations<strong>.<\/strong><\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-odbiorcy-danych\" class=\"wp-block-heading\"><strong>Data recipients<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The recipients of the data may be:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">providers of IT systems and\u00a0services, including hosting, maintenance of the Website, CRM systems, analytical and\u00a0marketing tools;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">entities providing accounting, legal, advisory, debt collection, courier, postal services and other entities supporting the Administrator in the\u00a0implementation of its activities;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">event organizers and\u00a0partners, if necessary to\u00a0handle the participation (e.g. hotels, conference facilities, technical subcontractors);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">advertising partners, providers of analytical and\u00a0social tools to whom data from\u00a0cookies is transferred (e.g. Google, Meta), in accordance with\u00a0their regulations and privacy policies;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">state authorities and\u00a0other entities authorized by law (e.g. police, courts, regulatory bodies, CSIRTs and\u00a0other KSC entities).<\/li>\n<\/ol>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">All entities processing data on\u00a0behalf of the Administrator operate on the\u00a0basis of appropriate entrustment agreements and\u00a0are obliged to\u00a0apply appropriate security measures.<\/p>\n\n\n\n<h2 id=\"h-przekazywanie-danych-poza-eog\" class=\"wp-block-heading\"><strong>Transfer of data outside the EEA<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">As a rule, data is not transferred to third countries (outside the European Economic Area) or international organizations, subject to the use of analytical, advertising and\u00a0social media tool providers based outside the EEA (e.g. Google, Meta). In the case of transferring data outside the EEA, the Controller ensures an adequate level of their protection by applying the mechanisms provided for in the GDPR (including decisions stating an adequate level of protection, standard contractual clauses, other instruments provided for in\u00a0Articles 46 to 49 of the GDPR). Information about the\u00a0intention to transfer data outside the EEA, together with a description of the safeguards used, is provided at the time of data collection or in the\u00a0content of this Policy.<\/p>\n\n\n\n<h2 id=\"h-prawa-uzytkownikow\" class=\"wp-block-heading\"><strong>5. User rights<\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In\u00a0connection with the\u00a0processing of personal data, you are entitled to:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">the right to access and\u00a0obtain a copy of the data (Article 15 of the GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">the right to Rectification (Art. 16 GDPR)<\/li>\n\n\n\n<li class=\"has-medium-font-size\">the right to\u00a0erasure (\"the right to\u00a0be forgotten\") in the\u00a0cases provided for in\u00a0Article 17 of the GDPR;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">the right to Restriction of Processing (Art. 18 DSGVO)<\/li>\n\n\n\n<li class=\"has-medium-font-size\">the right to data portability (Article 20 of the GDPR), to the\u00a0extent that the processing takes place on the\u00a0basis of consent or a contract and\u00a0in an automated manner;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">the right to object to processing based on the Controller's legitimate interest or for direct marketing purposes (Article 21 GDPR);<\/li>\n\n\n\n<li class=\"has-medium-font-size\">the right to\u00a0withdraw consent at\u00a0any time, without affecting the\u00a0lawfulness of processing carried out before its withdrawal;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">the right to lodge a complaint with the President of the Office for Personal Data Protection (UODO) when you consider that the processing violates the provisions on the\u00a0protection of personal data.<\/li>\n<\/ol>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In\u00a0order to exercise the above rights, you may contact the Controller or the Data Protection Officer using the data indicated in\u00a0point 1 of this Policy, in\u00a0particular by e-mail or traditional correspondence.<\/p>\n\n\n\n<h2 id=\"h-profilowanie-i-zautomatyzowane-podejmowanie-decyzji\" class=\"wp-block-heading\"><strong>Profiling and automated decision making<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">The Controller may conduct basic analytics and\u00a0segmentation (e.g. by type of services, usage history) in\u00a0order to match the content of the Website or marketing communication.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">As a rule, the Administrator does not make decisions against users based solely on\u00a0automated processing that would have legal effects on them or significantly affect them in\u00a0a similar way (within the meaning of Article 22 of the GDPR); any automated decisions result from\u00a0clear criteria provided for in\u00a0contracts and\u00a0regulations and are subject to human supervision.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">If the automated process would significantly affect\u00a0your rights or the legal situation, the Controller will provide you with the opportunity to obtain human intervention, express your own position and challenge the decision within the\u00a0limits of applicable regulations<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-bezpieczenstwo-danych-i-ksc\" class=\"wp-block-heading\"><strong>Data security and\u00a0KSC<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">The Controller applies technical and\u00a0organizational measures to ensure the security of personal data complying with the requirements of Articles 24 and\u00a032 of the GDPR, including, but not limited to, access control, encryption, pseudonymisation, backup procedures, incident monitoring and\u00a0testing of security measures.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">As an entity operating in the telecommunications sector and a key entity within the meaning of the Act on the National Cybersecurity System, the Administrator also implements organizational, technical and\u00a0procedural measures provided for in the National Cyber Security System, in\u00a0particular in the field of: risk management, incident handling, reporting serious incidents to the competent CSIRT, business continuity and security of the digital services supply chain.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Data from server and\u00a0system logs are used, among others, to\u00a0maintain and\u00a0manage the Website, ensure security, detect abuse and create aggregate statistics, without identifying specific users, unless it is necessary to\u00a0determine liability for\u00a0violations of law.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">In the event of a personal data breach that may cause a high risk of violating the rights or freedoms of natural persons, the Administrator \u2013 in accordance with the GDPR and special provisions \u2013 will notify the competent supervisory authority and data subjects, as well\u00a0as take the necessary corrective actions.<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-pliki-cookies-i-podobne-technologie\" class=\"wp-block-heading\"><strong>Cookies and\u00a0similar technologies<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list has-medium-font-size\">\n<li>As\u00a0part of the Website, cookies and similar technologies are used to, among others, ensure the proper functioning of the Website, adjust content, analyze traffic, conduct marketing activities and\u00a0integration with social media.<\/li>\n\n\n\n<li>Cookies are small text files stored on the user's device (computer, smartphone, etc.) that can be read by the Administrator's or third parties' IT system.<\/li>\n\n\n\n<li>The\u00a0Website uses the following categories of cookies:\n<ul class=\"wp-block-list\">\n<li>technical\/necessary cookies \u2013 necessary for the proper operation of the Website, ensuring security, maintaining sessions, handling forms; their use does not require the user's consent;<\/li>\n\n\n\n<li>functional\/analytical cookies \u2013 allow you to analyze the use of\u00a0the Website, create statistics and\u00a0reports, optimize content and\u00a0functionality; they are used on the\u00a0basis of consent;<\/li>\n\n\n\n<li>marketing cookies \u2013 are used to\u00a0profile users, conduct remarketing, match advertising content, also with the use of advertising partners; they are used on the\u00a0basis of consent.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list has-medium-font-size\">\n<li>During the first visit to the\u00a0Website, a cookie banner is displayed, through which the user can manage their preferences and\u00a0consent to\u00a0certain categories of cookies. These consents may be changed or withdrawn at\u00a0any time using the appropriate mechanism provided on the\u00a0Website (\"Cookie Settings\").<\/li>\n\n\n\n<li>The user can also independently manage cookies through the web browser settings (blocking, deleting, limiting).
